Agreement to these terms
Welcome to flypfc.com (the “Site”), operated by Precision Flight Controls, Inc. (“PFC,” “we,” “us” or “our”), 2747 Mercantile Drive, Suite 100, Rancho Cordova, CA 95742. By accessing or using the Site you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Site. We may update these terms from time to time; the date at the top of this page shows when they were last revised, and continued use of the Site after a change means you accept the revised terms.
Use of the Site
The Site provides information about PFC flight simulators, flight training devices, cockpit controls, avionics and related products and services, and lets you request a quote, contact us, read our updates and access FAA documentation for our devices. You may use the Site only for lawful purposes. You agree not to: copy, scrape or harvest content or data from the Site by automated means; attempt to gain unauthorized access to any part of the Site, its servers or any account; interfere with the Site’s operation or security; submit false, misleading or infringing information through our forms; or use the Site to send unsolicited commercial messages.
Product information, quotes and orders
Product descriptions, specifications, images, features and options on the Site are provided for general information and may change without notice. PFC products are sold on a quote basis; information on the Site is not an offer to sell, and no contract is formed until PFC accepts your order in writing. Prices, lead times, configurations and availability are confirmed in your written quote or sales agreement, which governs the purchase. Where a written quote, sales agreement or purchase order terms conflict with these Terms of Use, the written agreement controls.
Payment methods, our return policy, freight policy, warranty and Return Merchandise Authorization (RMA) procedures are published on our Customer Service page and form part of our terms of sale.
FAA documentation and training credit
Letters of Authorization (LOA), Qualification and Approval Guides (QAG) and other FAA documents on the Site are provided for reference. The amount of training credit allowed for a device is set by the FAA in that device’s LOA and the applicable regulations, and may change. Operators, instructors and pilots are responsible for confirming the current approval status of a device and for correct logbook entries. Nothing on the Site is flight instruction or regulatory advice.
Payment Terms and Conditions
- All funds must be submitted in US Dollars only.
- All funds to be verified prior to production commencement and/or shipment.
- Shipment dates are contingent upon timely receipt of payment.
- California state sales tax will be applied to all orders shipped to a destination located within the State of California.
- California state sales tax for the City of Rancho Cordova will be applied to all orders picked up at our facility.
- Orders delivered by a PFC representative to a destination located within the State of California will be subject to California state sales tax for the city in which the delivery occurs.
- Sales tax exemption documentation must be provided upon order placement.
Intellectual property
The Site and its content, including text, graphics, photographs, video, logos, product designs, software and the selection and arrangement of the content, are owned by PFC or its licensors and are protected by United States and international copyright, trademark and other laws. Precision Flight Controls, PFC, Train Better. Fly Safer., and PFC product names such as CR-12, CRX, GTX, DCX MAX, Modular Flight Deck, Heli-Sim and HELIMOD are trademarks or trade names of Precision Flight Controls, Inc. Aircraft manufacturer names and other third-party names and marks that appear on the Site (for example Boeing, Cessna, Piper, Beechcraft, Pilatus, Bell, Garmin, X-Plane, Varjo and D-BOX) belong to their respective owners and are used to identify the aircraft, avionics or equipment a product simulates or works with. Their use does not imply affiliation, sponsorship or endorsement.
You may view, download and print pages from the Site for your own business evaluation of PFC products. Any other reproduction, distribution, modification or public display of Site content requires PFC’s prior written permission.
Information you submit
When you submit a quote request, contact message or comment, you confirm the information is accurate and that you have the right to provide it. By submitting a comment or other public content you grant PFC a non-exclusive, royalty-free license to display it on the Site. PFC may remove any submission at its discretion. Personal information you submit is handled as described in our Privacy Policy.
Accounts
Some areas of the Site may require a login. You are responsible for keeping your login credentials confidential and for activity under your account. Tell us promptly if you believe your account has been used without authorization.
Third-party websites and services
The Site contains links to, and embedded content from, third-party websites and services, including video platforms, social networks and our financing partners. PFC does not control and is not responsible for their content, terms or privacy practices. Financing is provided by independent third parties under their own terms; PFC is not a lender.
Export compliance
PFC products and technical data may be subject to United States export control laws and regulations. You agree not to export, re-export or transfer any PFC product or technical information obtained through the Site in violation of those laws.
Disclaimer of warranties
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, PFC disclaims all warranties regarding the Site, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy. PFC does not warrant that the Site will be uninterrupted, error-free or free of harmful components. This section applies to the Site only; product warranties are stated separately in our written warranty terms.
Limitation of liability
To the fullest extent permitted by law, PFC and its officers, directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or business, arising out of or related to your use of or inability to use the Site, even if advised of the possibility of such damages. PFC’s total liability for any claim relating to the Site will not exceed one hundred US dollars (USD 100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
Indemnification
You agree to indemnify and hold harmless PFC and its officers, directors, employees and agents from any claims, damages, losses and expenses, including reasonable attorneys’ fees, arising from your violation of these terms or your misuse of the Site.
Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute relating to the Site or these terms will be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to their jurisdiction.
General
If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These terms, together with the Privacy Policy and any written sales agreement, are the entire agreement between you and PFC regarding the Site.
